Terms and Conditions
This Rental Agreement and Contract (“Agreement”) constitute a binding contract made and entered into as of the Reservation Date set forth below by and between the undersigned individual(s) or entity (referred to as the “Guest”) and the undersigned owner, manager, or agent (referred to as the “Rental Agent”), whereby the Guest has agreed to rent the residence described below (referred to as the “Property”) for the duration of the Rental Term, in consideration of the Total Rental Fee and other valuable consideration as outlined herein.
CONDITION AND USE OF PROPERTY
The Property is provided in the condition as marketed. The Rental Agent will endeavor to ensure the proper operation of all amenities within the Property, such as internet access, satellite or cable TV access, hot tubs, and fireplaces as applicable. However, the Rental Agent shall not be held liable for any failure of such amenities, although every effort will be made to rectify reported issues promptly. The Guest acknowledges that the use of amenities such as hot tubs, pools, spas, fireplaces, decks, etc., may entail potential risks if not used properly, especially concerning children, and such use is solely at the Guest’s own risk.
The Guest agrees to use the Property strictly for residential purposes and in a manner that prevents any damage or loss to the Property. The Guest must maintain the Property in a clean and sanitary condition at all times. Furthermore, the Guest and any additional permitted guests must refrain from causing disturbances, loud noises, or inconvenience to neighbors. The Property shall not be used for immoral, offensive, or unlawful purposes, nor shall any laws, association rules, or ordinances be violated. Any waste or nuisance on or about the Property is strictly prohibited.
WAIVER OF LIABILITY
By accepting this agreement, the Guest and/or their guests acknowledge and accept all risks of personal injury, death, and/or property damage occurring on or around the premises during the lease term. The Guest further agrees to indemnify and hold harmless the Lessor and/or Lessor’s agents from any bodily injury, death, and/or property damage sustained during the lease term.
DEFAULT
In the event of the Guest’s failure to comply with the terms and conditions of this Agreement, the Guest shall vacate the Property, remove all belongings, and leave the Property in good order, without damage. No refund of the Total Rental Fee shall be issued, and the prevailing party in any legal action shall be entitled to reimbursement of all incurred costs.
ASSIGNMENT OR SUBLEASE
The Guest shall not assign or sublease the Property or permit its use by persons not included within the permitted occupants under this Agreement, except for family members or approved guests.
INDEMNIFICATION
The Guest agrees to indemnify the Lessor for any liabilities, theft, damage, costs, or expenses arising from or related to any claims or litigation arising from the Guest’s use of the premises during the lease term and/or the use of the premises by the Guest’s guests.
ENTRY AND INSPECTION
The Rental Agent reserves the right to enter the Property with the prior consent of the guests for maintenance, repairs, or inspection purposes.
UNAVAILABILITY OF PROPERTY
If the Property becomes unavailable for use during the Rental Term due to circumstances beyond the control of the Rental Agent, the Rental Agent will make reasonable efforts to find a suitable replacement property. If a replacement property cannot be found, all payments made by the Guest shall be refunded, and this Agreement shall be terminated.
SWIMMING POOL
The Guest acknowledges that there is no lifeguard provided on the premises. The use of the pool is considered inherently risky, and the Guest assumes full responsibility for their safety and that of their guests during the lease term.
CANCELLATION
If the Guest cancels their reservation sixty (60) days or more prior to the start of the lease term, the deposit amount is fully refundable, minus any applicable banking fees. If the cancellation occurs less than sixty (60) days before the start of the lease term, the rental amount is forfeited. Cancellation or amendment requests must be submitted in writing via email and will be effective upon receipt by the Rental Agent. The following charges will apply:
- More than 60 days before arrival date: 0% of the booking price.
- Less than 60 days before arrival: 100% of the booking price.
- No refunds will be issued if the Guest voluntarily decides to discontinue the use of services included in the vacation before the end of their stay.
The purchase of travel insurance to cover unexpected cancellations is strongly recommended. The Guest is encouraged to consider purchasing travel insurance to protect against unforeseen circumstances that may result in the cancellation or interruption of their stay, leading to the forfeiture of any non-refundable pre-payments or payments made for their trip.
EVICTION, LAW and AGENCY
In the event of a breach of any term of this Agreement by the Guest, the Lessor reserves the right to evict the Guest without notice, and no refund will be given. The parties agree that the laws of the Turks and Caicos Islands, British West Indies, shall govern this Agreement. The Lessor or its designated agent may administer this Agreement, and the Guest agrees to release and hold harmless the Lessor’s agent.
SEPTIC SYSTEM
The Guest acknowledges that the septic systems at Isle Haven properties utilize a natural bacterial process to break down waste. Therefore, the Guest agrees not to flush hygiene, and personal care products, or wipe down the toilets, as this can block the pipes and disrupt the natural processes, causing inconvenience to other guests when systems block and overflow.
NON-SMOKING / NO ANIMALS ALLOWED
The units are strictly non-smoking, and animals are not allowed inside. The Guest will be subject to a fine and cleaning fee of $300.00 (three hundred US dollars) plus applicable fees on their credit card if these rules are violated.
SECURITY DEPOSIT
Isle Haven is committed to protecting the homes of our owners during bookings. Therefore, we have partnered with Know Your Guest. Know Your Guest, via Superhog, is a leading vacation rental guest-screening provider. They independently verify our guests and collect a deposit or offer a damage waiver. It is recommended that the Guest purchase the damage waiver, as it provides protection in the event of accidental damage during the booking.
ACKNOWLEDGEMENT
By signing this agreement, the Guest confirms that they have read, understood, and agreed to the terms and conditions outlined herein. The Guest further acknowledges that they are executing this agreement on behalf of all parties listed on the guest list. The credit card provided at the time of reservation will be held for backup security purposes only. Unpaid rent, excessive cleaning, damage, lost keys, or lock-outs may be charged to this card if necessary.
I agree that this is a legally binding document and I have read all terms and conditions contained within.
DATA PROTECTION
In compliance with the Organic Law 15/1999 of 13th December, on the Protection of Personal Data (“LOPD”), we inform you that your personal details will be collected and stored in the company files for the purpose of providing our services. You have the right to access, rectify, cancel, and oppose the use of your personal data. The company is responsible for managing the file.
